Terms and Conditions

1. 1 I / We clearly understands the terms and conditions of the special enrolment offers that I/ we have chosen at the time of signing up of Alegria holidays membership.
1.2 I/We acknowledge that I/we have read the membership terms of Alegria holidays and hospitality ltd and I/we agree to comply by it. I have received all the clarifications and information on the terms of membership taken by me.
1.3 I/We understand that I/we are not eligible for refund of admission fee paid to Alegria holidays and hospitality ltd for the request for cancellation of membership after the recession period.
1.4 I/We understand that I /we shall be admitted as a member to Alegria holidays and hospitality ltd membership only upon the full payment of membership fee.
1.5 I/We understand that all the enrolment benefits relating to my Alegria holidays and hospitality ltd membership is based on the membership category purchased.
1.6 I/We understand that I/we have the right to transfer my membership and that Alegria holidays and hospitality ltd shall not be liable / bound to have the same transfer or buy back from me/us.
1.7 I/We understand that the confirmation of reservation on room bookings is subject to availability.
1.8 I/We understand that Alegria holidays and hospitality ltd needs to maintain the hotels / resorts towards which I/we agree to pay annual subscription fees even if I/we have not availed of a stay in a particular year or not and nonpayment of the same shall result in disentitlement from the use of and/or termination/cancellation of Alegria holidays and hospitality ltd membership.
1.9 I/We understand that any part payment made by me/us towards any outstanding shall not be refunded and membership will not be created until I /we make the full payment of the membership fee.
1.10 I/We understand that Alegria holidays and hospitality ltd shall have the right to terminate my membership in case of any default in payment of any installment by me/us as mentioned in the terms.
1.11 I/We have read the terms of cancellation and deductions as applicable to cancellation post recession period mentioned in the membership rules and I/ we agree to the same.
1.12 I/We acknowledge that apart from the agreed terms mentioned in the membership terms there is no verbal /written promises or any other assurances by any personnel of Alegria holidays and hospitality ltd.
1.13 I/We agree that to in order to become a member of Alegria holidays and hospitality ltd I must and I have completed 18 years of age.
1.14 I/We confirm Alegria holidays and hospitality ltd reserve the right to refuse any enrollment application including without limitation if required to do so by the laws, rules or regulations of any local , state , national or federal government entity or by any judicial, public, regulatory or law enforcement authority or court.
1.15 Alegria holidays and hospitality ltd do not encourage any credit facilities to any of its member availing our services at any of our facilities.

Introduction
Alegria holidays and hospitality Ltd., a limited company incorporated under the provisions of this company Act 1956, having its registered office at Flat No B,First Floor, Royal Court,Door No 41,Venkatnarayana Road,Chennai-600017. Tamil Nadu, India.
These terms of membership sets out a legally binding contract between Alegria holidays and hospitality ltd and each person who uses our services/property in different capacity.
These terms of membership shall be governed by and construed in accordance with the laws of India.
These terms of membership will be applied to all the facilities or services offered by Alegria holidays and hospitality ltd to its members, their travelling companions and their guests who uses all services together with any other applicable terms and conditions notified to you by Alegria holidays and hospitality ltd.

2. MEMBERSHIP ADMISSION
2.1 As stated in 1.4 of this document an applicant is admitted as a member of Alegria holidays and hospitality Ltd only upon the full payment of membership fee.
2.2 Various options are available for members to remit their payments. An applicant can remit their payments through our website or they have the facility to make part payments by submitting post dated cheques or ECS or direct payments.
2.3 The applicant further recognizes that the admission fees/membership price is not refundable.
2.4 The members shall be awarded with a plastic membership card within 15 days after making the full payment for membership. The card shall indicate the membership number and the type of membership, name and the validity. The plastic membership card shall be the conclusive proof of your membership with us.

3. PROCESS OF AVAILAING HOLIDAYS
3.1 A member can avail the offer or reserve any room by placing a request for reservation in our Toll-free number or by logging on to our website or any other reservation method as prescribed by Alegria holidays and hospitality ltd. In the event joint applicants have raised the request for availing holidays, the same shall be entertained only from the principle member.
3.2 Applicant further recognizes that reservations shall be made on the first come first serve basis and or subject to availability.
3.3 On confirmation of the availability of rooms, Alegria holidays and hospitality ltd shall issue a conformation e-mail specifying all the details regarding your reservation. The members acknowledge to abide with the Terms & Condition as mentioned in the e-mail.
3.4 We do collect any utility charges for your room stay with us.
3.5 The following terms shall apply in the event of cancellation of confirmed holidays:
3.5.1 Any request for the cancellation of confirmed holidays shall be made by the member in writing via e-mail. The date of receipt of the request for cancellation by Alegria holidays and hospitality ltd shall be reckoned as the date for the purpose of determining the applicability of cancellation norms.
3.5.2 If the cancellation are made before 15(Fifteen) days of commencement of holidays re-credit shall be on the entire number of days of holiday and if the cancellation is made less than 15(Fifteen) days from the date of holiday the entire number of days shall be debited.
3.5.3 If, Alegria holidays and hospitality ltd is unable to provide its holiday services due to any reasons beyond its control even after issuance of confirmation, we ensure to give alternate accommodation and in any event such services are not provided we ensure to refund the entire amount paid to the members account.
3.5.4 Notwithstanding anything stated herein above Alegria holidays and hospitality ltd shall not incur any liability and is not in position to fulfill its obligations by reason of any war civil commotion, force majeur, act of God, other notification from any court of Law or government or any other reason beyond the reasonable control of Alegria holidays and hospitality ltd.
3.5.5 As per the applicable government guidelines / Know Your Customer (KYC) norms, any member availing our service is liable to submit the required Government issued documents towards his/her/its proof of address and identity at the time of check-in at the ALEGRIA Hotels/Resorts.

4. Annual Subscription Fees (ASF)
4.1 A member should pay their ASF in full so that they can enjoy their complete holiday entitlements.
4.2 ASF once paid is not refundable and non-payment of ASF would amount to breach of contract.
4.3 Alegria holidays and hospitality ltd reserves the right to charge additional fees including access fee or such other charges as may be prescribed from time to time for usage of our facilities /services.

5. Terms of refund
5.1 A member can terminate the membership during the time of membership period by making a request in writing duly signed.
5.2 Any Part / Full payment made towards the Membership is non refundable.
5.3 In the happening of following events Alegria holidays and hospitality ltd reserves the right to terminate the membership ;
• Default in payment of membership price by the member
• Default in payment of annual subscription fee
• Breach of contract by the member
• Any other action by the member and /or his/her/its guest or occurrence of any event or situation with in the premises of Alegria holidays and hospitality ltd resorts/hotels which we do not have reasonable control.

6. Taxes
6.1 A member/shall be liable to pay all the taxes/charges/levies statutory or otherwise imposed by or payable to any government/local body or any other authority on membership price.
6.2 Non payment of taxes and levies shall disentitle the member from enjoying holidays and shall amount to breach of contract and result in termination of membership.

7. Arbitration and Jurisdiction
7.1 All or any dispute, differences or questions arising out of this transaction shall be settled by arbitration by a sole arbitrator to be appointed by Alegria holidays and hospitality ltd.
7.2 The arbitration proceedings shall be as per the provisions of the Indian Arbitration and Conciliation ACT 1996. Including any amendments thereto the venue of such arbitration shall be Chennai. The language used in the arbitration proceedings shall be in English only. The award passed by the arbitrator shall be final and binding on the applicants/members and Alegria holidays and hospitality ltd.

DISCLAIMER
• Alegria holidays ltd reserves the right to vary, withdraw or add to any services it provides at anytime, with or without prior notice.
• Alegria holidays ltd has the right to amend its terms and conditions from time to time with or without prior notice.
• Alegria holidays ltd shall not be liable for any loss/injury caused to any member or his family or guest while using the facilities of the club or accident occurred in the normal course of using the facility.

DECLARATION
I/We have carefully gone through the terms mentioned above and agrees to comply with the same and I understand that, any violation of the above terms shall lead me /us to the termination of my/our agreement with Alegria holidays Ltd. I/We agree that any decision taken by Alegria holidays Ltd shall be final.
